Terms of Service

1. Acceptance

By creating a FoodApp account or using the service, you agree to these Terms. If you do not agree, do not use the service. These Terms form a binding agreement between you ("Customer") and FoodApp ("we", "us").

2. The Service

FoodApp provides a multi-tenant SaaS platform for restaurants to publish digital menus accessible by QR code, receive in-house and pickup orders, and manage their operation through a web dashboard. Specific features available depend on the plan selected.

3. Account & eligibility

You must be at least 18 years old and authorized to bind the legal entity operating the restaurant. You are responsible for the accuracy of registration information, the security of your credentials, and all activity under your account.

4. Trial & billing

New accounts receive a 14-day free trial of the Pro plan. After the trial ends, you may downgrade to the free Starter plan or subscribe to a paid plan. Paid plans are billed in advance on a monthly or annual cycle. Fees are non-refundable except where required by law. We may change pricing with 30 days' notice.

5. Acceptable use

You agree not to use FoodApp to publish illegal content, infringe intellectual property, transmit malware, attempt to circumvent technical limits, reverse-engineer the service, or operate the platform on behalf of a competitor. We may suspend accounts that violate these rules.

6. Your content

You retain ownership of menus, product names, photographs and other content you upload ("Customer Content"). You grant us a worldwide, non-exclusive licence to host, display and process Customer Content solely to operate the service. You are responsible for the legality of Customer Content.

7. Orders & end customers

Orders placed through your tenant page are contractual relationships between you and the end customer. FoodApp is a technology provider and is not a party to those transactions, does not handle payment processing in the MVP, and is not responsible for food safety, preparation, fulfilment or refunds.

8. Service availability

We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, deploy updates, or restrict features without prior notice when necessary. We are not liable for downtime caused by third-party providers, force majeure, or your own infrastructure.

9. Limitation of liability

To the maximum extent permitted by law, FoodApp's aggregate liability arising from or related to the service shall not exceed the fees paid by you in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, lost-profits or consequential damages.

10. Termination

You may cancel at any time from the dashboard. We may suspend or terminate accounts for breach, non-payment, or as required by law. On termination we will retain your data for 30 days to allow export, after which it will be permanently deleted.

11. Governing law

These Terms are governed by the laws of the Republic of Bulgaria. Disputes shall be resolved by the competent courts of Sofia, Bulgaria, subject to applicable consumer protection rules.

12. Changes

We may update these Terms. Material changes will be announced via email or in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
